Terms
The terms on which we supply the logger and the monitoring service.

These terms are adapted from the open-source policies published by 37signals under a Creative Commons Attribution 4.0 licence, with thanks. They have been rewritten for a British business selling hardware as well as a service, so the differences are deliberate.
Who you are dealing with

What you are buying
A logger, which is yours once you have paid for it, and access to the monitoring service at your own web address. [Set out here what the service costs, what is included in the price of the hardware, and how long that lasts.]
What the service does
Your logger reads your battery and sends those readings to us. We store them and show them to you. That is the whole of it.
What it is not. It is not an alarm system and it is not a safety device. It will not call you, cut anything off, or intervene if your battery misbehaves. Do not rely on it to prevent a fault, and do not use it in place of the protection built into your battery and your installation.
Gaps happen. If your internet or power goes down, readings from that period are lost, not delayed — the logger does not currently store them up and send them later. Your battery keeps working; the record of what it did does not exist.
We may update your logger. From time to time we will send it new firmware to fix faults or add things. It may restart while it does so.
Your side of it
- Install the logger safely, or have someone competent do it. If in any doubt about working near a battery, get an electrician.
- Keep your sign-in details to yourself. Anyone who has them can see your battery.
- Do not try to break into, overload or interfere with the service, or with anyone else’s data.
Your account
You are responsible for keeping your password safe — we cannot recover it and we will never ask you for it. You must be a human being: accounts registered by automated means are not permitted. You are responsible for anything that happens under your account.
One person or business per account. If you want a second address for a second property, that is a second account.
Changes to the service and the price
We may change what the service does. Sometimes that means adding things, occasionally it means removing something that few people used or that we could not keep working properly. We will not remove something you rely on without telling you.
If we change the price we will give you [notice period, e.g. 30 days] beforehand, and it will never apply to a period you have already paid for.
Features and faults
We decide what goes into the service and what does not. That said, we built this because we wanted it ourselves, and if something is wrong or missing we would rather hear about it than not — tell us.
If something is wrong with the hardware
You have legal rights if goods are faulty, not as described, or not fit for purpose. Nothing here affects those rights. If a logger fails [state the warranty period, e.g. within 12 months] we will repair or replace it.
Changing your mind
If you bought at a distance as a consumer you may cancel within 14 days of receiving the logger and return it for a refund. Tell us at ukonewatt@gmail.com. [State who pays return postage and the condition it must come back in.]
Ending it
You can stop using the service whenever you like and ask us to delete your account and its data. The logger is yours and will keep working — you can point it at your own MQTT broker instead.
We may suspend or end an account that is being used to attack the service or to break the law. If we ever stop offering the service altogether we will give you [notice period, e.g. 30 days] and a way to take your data with you.
Where we stand on liability
We do not limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.
Otherwise, and because this is a monitoring tool rather than a protective one, we are not liable for loss or damage to a battery or an installation, for lost income or profit, for data that was never recorded, or for anything arising from readings being missing, late or wrong. Our total liability to you is limited to [e.g. what you paid us in the previous 12 months].
We will try to keep the service running, but we do not promise it will always be available.
In plainer words: using this service means betting that a small company keeps a website running. We think that is a reasonable bet and we work at it — but if the site is down, or a reading never arrived, what you can ask of us is limited to what you paid us. What you must not do is rely on it to keep a battery safe. That job belongs to the battery’s own protection and to whoever installed it.

The rest
These terms are governed by the law of [England and Wales, or Scotland], and its courts. If any part of them turns out not to hold, the rest still does.
